Data processing for Arkema's jobs portal

To apply for job offers on the Arkema Recruiting System, we ask you to register on our Jobs Portal, and to upload your application. Please find below our information notice on the protection of personal data of the Jobs Portal of Arkema.
Arkema offers an online system dedicated to recruitment. The use of the Jobs Portal involves the processing of your personal information ("Personal Data"). Arkema will pay special attention to the protection of your Personal Data while using the Jobs Portal.

This information notice (“Notice”) will provide you with information on our data processing activities with respect to certain Personal Data about you when accessing and using the Arkema Jobs Portal to:

  • Create an account in the Jobs Portal inter alia used to store your application data and/or
  • Apply for a specific job offering of an entity belonging to the Arkema Group – a list of the Arkema entities can be found here, while the relevant entity is indicated within a specific job offering.

The Notice considers the rights and obligations set forth in the EU General Data Protection Regulation (Regulation (EU) 2016/679, “GDPR”).

 

I. Preamble

1. Arkema with its registered office at 420 rue d’Estienne d’Orves 92700 Colombes, France, and other companies of the Arkema group collect and use certain Personal Data. Arkema is responsible for ensuring that Personal Data are processed in compliance with data protection laws and regulations.

2. We use the following definitions in this Notices:
- “Arkema”, “we” or “us” means Arkema and other companies in the Arkema group.

- “Personal Data” means any data which relates to a living individual who can be identified from that data or from that data and other information which is in the possession of, or is likely to come into the possession of, Arkema (or its representatives or service providers). In addition to factual information, it includes any expression of opinion about an individual and any indication of the intentions of Arkema or any other person in respect of an individual.

 

II. Your Personal Data and processing purposes

1.  General

We will process certain individually identifiable information about you when you access and use the Jobs Portal that you provide us with when creating an account, setting up a profile and/or applying for a job on the Jobs Portal (“Personal Data”) including such Personal Data received from you or authorized third parties (e.g., approved recruitment agencies which you authorized to submit your Personal Data to us).

In addition to Personal Data collected via the Jobs Portal, we may collect further Personal Data about you to the extent permitted or required under applicable law, for purposes connected with your profile on the Jobs Portal or a specific application for a job.

We collect such Personal Data in order to enable you to create an account, set up a profile and/or apply for a job on the Jobs Portal as well as to inform you about new job posting notifications and send information about career opportunities.

 

2. Which Personal Data are collected?

While creating your account and/or applying to a job offer, we will collect the following Personal Data:

  • Your login information: username and password;
  • Your general personal information, such as first name, last name, e-mail address, phone number, address, city, zip code, country;
  • The information provided on your resume, such as professional experience, photo, education, professional certifications, language skills;
  • The professional preferences that you provide us with, via the Jobs Portal (that is, the types of jobs that you are interested in, geographic mobility);
  • Any other personal information (including sensitive information, such as possible disabilities) that you decide to enter voluntarily on your profile, or include in your resume without being obliged to;
  • Your IP address and browsing routes on the website.

You can edit or delete your profile at any time.

Furthermore, each time you use your account, we store date and time of your login in order to allow you to verify when you were last logged into your account and to enable us to notify you about a pending deletion of your account due to long-time inactivity (See Article 8 of the Notice).

 

3. What are the purposes of the processing of your Personal Data?

We will process your Personal Data for the following purposes:

  • To create an account and your profile in the database, for technical support or for any other useful purpose, such as identifying opportunities that align with your interests and preferences;
  • To submit your application to different affiliates of the Arkema group, according to your instructions, via the Jobs Portal ;
  • To be visible in Arkema's candidate database. Please note that if you want to use this feature, you must first enable it. Only then will the people in charge of recruiting within Arkema see your profile and offer you job opportunities in the event of a current or future vacancy. You will be able to deactivate this feature again, at any time, via the Jobs Portal;
  • To create anonymized statistics (so that we can evaluate, for example, the number of candidates who have applied for a particular offer, without analyzing the applications accurately);
  • To establish, enforce or defend against filing a complaint and to fulfill legal obligations (such as accounting, regulatory and administrative requirements), to comply with requests from courts or regulatory bodies, or, where necessary to investigate, prevent or take action regarding illegal activities, in cases of suspected fraud, situations involving potential threats to the safety of others or violation of Arkema's policies or conditions.

 

4. Who are the recipients of your Personal Data?

For the purposes mentioned above, the following recipients and categories of recipients will have access to your Personal Data:

  • Human Resources and managing functions within Arkema to administer applications and candidate information at a group wide level;
  • To agents, service providers and third-party consultants (for example to carry out computer maintenance or provide support in connection with human resources);
  • To governmental authorities, courts and regulators, when necessary and to comply with applicable laws and regulations;
  • To any other party, in case of reorganization, merger, sale, joint venture, assignment, transfer, or any other provision related to the entirety or parts of our business, our assets, or our actions.

Your Personal Data will be shared only on a “need-to-know” basis. We will not disclose your Personal Data to parties who are not authorized to process it.

 

5. On what legal basis do we collect, process and use your Personal Data?

In connection with the use of the Jobs Portal, we will collect, process and use your Personal Data on the basis of your consent to this Notice:

  • To create and store your profile, in accordance with this Notice;
  • To make your profile available to Arkema's companies, at your request, via the Jobs Portal;
  • To offer you job offers in connection with the information you provide in the Jobs Portal and your interests and preferences.

If necessary, we may also have to process your Personal Data when necessary:

  • To comply with a legal obligation to which we are subject to;
  • For the preservation of our legitimate interests.

 

6. Where will your Personal Data be processed?

Your Personal Data may be transferred outside the country you are located and processed worldwide, both inside and outside the European Union (EU) and the European Economic Area (EEA), by the parties specified above.

Please note that all countries, even those in the EU and the EEA, have different laws regarding the protection of Personal Data. When your Personal Data is transferred from your country to another country, the laws and regulations that protect your Personal Data in the country to which your information is transferred to may be different from your country's.

Some recipients located outside of the European Economic Area (“EEA”) are certified under the EU-U.S. Privacy Shield and others are located in countries for which the European Commission has issued adequacy decisions.

In each case, the transfer is thereby recognized as providing an adequate level of data protection from a European data protection law perspective (Art. 45 GDPR).

 

7. How do we protect your Personal Data?

Arkema implements appropriate technical and organizational security measures designed to protect your Personal Data against accidental or unlawful destruction, accidental loss or alteration, unauthorized disclosure or access. All our employees and partners are bound by confidentiality and can only process your Personal Data on a "need to know" basis principle.

 

8. How long will be retained your Personal Data?

You can manage your account and the Personal Data you have provided us with at any time by:

  • Deleting your entire account
  • Deleting all or selected information in your profile
  • Withdrawing an application

All three options will lead to the deletion of some or all your Personal Data, except to the extend we are required by law to keep the respective data.

We are committed to keeping your Personal Data as long as it is necessary to fulfill the purposes for which it was collected, and to fulfill our legal obligations.

We shall delete your account if you have not logged into your account for more than two years. In such case, you will receive a separate notification informing you about the upcoming deletion in order to give you the opportunity to prevent the deletion of your profile.

Your Personal Data will not be kept in a form that allows you to be identified for any longer than is reasonably considered necessary by Arkema for achieving the purposes for which it was collected or processed or as it is established in the applicable laws related to data retention periods or as permitted by applicable laws.

 

9. What are your statutory rights?

Under the conditions set out under applicable law (i.e., the GDPR), you have the following rights:

  • Right of access:
    You have the right to obtain from us confirmation as to whether or not Personal Data concerning you is being processed, and, where that is the case, to request access to the Personal Data. The access information includes – inter alia – the purposes of the processing, the categories of Personal Data concerned, and the recipients or categories of recipients to whom the Personal Data have been or will be disclosed.
    You have the right to obtain a copy of the Personal Data undergoing processing. For additional copies requested by you, we may charge a reasonable fee based on administrative costs.
  • Right to rectification: 
    You have the right to obtain from us the rectification of inaccurate Personal Data concerning you. Depending on the purposes of the processing, you have the right to have incomplete Personal Data completed, including by means of providing a supplementary statement.
  • Right to erasure (right to be forgotten): 
    You have the right to ask us to erase your Personal Data.
  • Right to restriction of processing: 
    You have the right to request the restriction of processing your Personal Data. In this case, the respective data will be marked and may only be processed by us for certain purposes.
  • Right to data portability: 
    You have the right to receive the Personal Data concerning you which you have provided to us in a structured, commonly used and machine-readable format and you have the right to transmit those Personal Data to another entity without hindrance from us.
  • Right to object:
    You have the right to object, on grounds relating to your particular situation, at any time to the processing of your Personal Data by us and we can be required to no longer process your Personal Data. If you have a right to object and you exercise this right, your Personal Data will no longer be processed for such purposes by us. Exercising this right will not incur any costs.

Such a right to object may not exist, in particular, if the processing of your Personal Data is necessary to take steps prior to entering into a contract or to perform a contract already concluded.

Please note that the aforementioned rights might be limited under the applicable national data protection law.
If you wish to exercise your data subject rights, please address your request to the data protection referent at dataprotection@arkema.com.
In case of complaints, you also have the right to lodge a complaint with the relevant data protection authority, in particular in the Member State of your habitual residence or alleged infringement of the GDPR.
